Welcome to XportEdu (the “Platform”), operated by XportEdu (“XportEdu,” “we,” “our,” or “us”). These Terms of Service (“Terms”) are a binding legal agreement between you and XportEdu that governs your access to and use of the Platform, including all websites, applications, widgets, and services we provide.

By creating an account, checking the box indicating your agreement, or otherwise accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you may not access or use the Platform.

If you are under 18 years of age, you may only use the Platform with the involvement, review, and consent of a parent or legal guardian, who must agree to these Terms on your behalf and who accepts responsibility for your use of the Platform.

XportEdu connects the participants in international student exchange and placement, including students, parents and guardians, schools, host families, sending organizations and agencies, receiving organizations, and local coordinators. Different features are available to different types of users, and additional role-specific terms may apply.

• Minimum age. The Platform is intended for users who are at least 13 years old. It is not for children under 13, and we do not knowingly allow anyone under 13 to create an account or provide information.
• You must be at least 18 years old to create an account on your own behalf, or have a parent or legal guardian create and manage the account for you.
• Minors (under 18). If you are under 18, a parent or legal guardian must review and affirm consent before your information — including any health information — is shared with the schools, organizations, coordinators, or host families involved in a placement. We confirm this consent through a link sent to the parent or guardian’s email address. The parent or guardian agrees to these Terms on your behalf and accepts responsibility for your use of the Platform.
• Authority to act for an organization. If you create or manage an account for a business or organization — including a school, sending organization, agency, receiving organization, or coordinator entity — you represent and warrant that you are duly authorized to act on behalf of that organization and to bind it to these Terms. If you lose that authority, you must stop using the account and notify us.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not you authorized it.
• You may not create an account using false information, impersonate any person or organization, or misrepresent your affiliation with any person or organization.

You represent and warrant that all information you submit to the Platform — about yourself, your organization, your students, your programs, your pricing, or anything else — is true, accurate, current, and complete, and that you will keep it up to date. You are solely responsible for the information you provide, and you acknowledge that other users and the public may rely on it.

The Platform is built to be open and transparent: much of the information organizations enter is intended to be published, searched, discovered, and shared so that students, families, and educators can connect. Two different rules apply depending on the type of content.

You represent and warrant that, for every photograph, image, logo, document, video, and other material you upload, you own it or have all rights, licenses, and permissions necessary to upload it and to grant the license in Section 5.

• You have obtained the consent of every identifiable person shown in any photo or video you upload to have their image used and displayed as described in these Terms and used for marketing and promotional purposes.
• Minors. Where any photograph or material shows a person under 18, you confirm you have obtained the consent of that person’s parent or legal guardian.
• Your content does not infringe any copyright, trademark, privacy, publicity, or other right of any third party, and does not contain unlawful, defamatory, or harmful material.

The purpose of the Platform is to connect people. By creating an account, you agree that other users may find your listing or profile and contact you through the Platform, and that XportEdu may contact you, using the contact information you provide, for purposes related to placements, connections, service updates, and the operation of the Platform. Contact preferences and how to opt out of non-essential communications are described in our Privacy Policy.

XportEdu exists to make international education more open and transparent — to connect students, educators, host families, and organizations for the benefit of students’ education, family and cultural exchange, and international understanding and diplomacy. You agree to use the Platform consistent with this purpose and in good faith toward other users.

You agree not to:

• Provide false, misleading, or fraudulent information;
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation;
• Facilitate visa fraud, immigration violations, or any misrepresentation to any authority;
• Attempt to access, tamper with, or use another user's account or data without authorization;
• Harass, abuse, threaten, defraud, or harm any other user;
• Scrape, harvest, or collect other users’ information except as the Platform intends, or use bots or automated tools without our permission;
• Upload malware or interfere with, disrupt, or overload the Platform or its infrastructure;
• Misuse personal information you access through the Platform, or use it for any purpose other than the connection it was shared for.

The Platform uses cookies and similar technologies to keep you signed in, remember your preferences, operate core features, and understand and improve how the Platform is used. By using the Platform you consent to this use as described in our Privacy Policy, where you can also learn how to control cookies.

We keep your information for as long as your account is active and for a period afterward so that records remain available if you return, if a placement or connection needs to be referenced, or as required by law. Our current practice is to retain account and record data for up to approximately three (3) years after an account is closed, after which it is deleted or anonymized, except where we are legally required or permitted to keep it longer. Because XportEdu may in the future offer related educational services (for example, programs beyond high school), you agree that, with your consent at that time, we may carry your record forward into such services. XportEdu is a platform that facilitates connections. We are not a party to any agreement, placement, enrollment, or arrangement made between users, and we do not guarantee that any student will be placed, that any school or host family will receive a placement, or that any connection will lead to a particular outcome. You are responsible for your own due diligence, decisions, agreements, and compliance with applicable laws.

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any information on it is accurate or complete.

To the maximum extent permitted by law, XportEdu and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Platform will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or one hundred U.S. dollars (US$100).

You agree to indemnify and hold harmless XportEdu and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your content or the information you submit; (b) your use of the Platform; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party, including any person shown in content you upload.

You may stop using the Platform and close your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, create risk or legal exposure for us or other users, or if we discontinue the Platform. Sections that by their nature should survive termination — including the license you granted, the warranties you made, disclaimers, limitation of liability, and indemnification — will survive.

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-law rules. Except where prohibited by applicable law, you agree that any dispute arising out of or relating to these Terms or the Platform will be resolved exclusively in the state or federal courts located in Nevada, and you consent to their jurisdiction. We may update these Terms from time to time. If a change is material, we will provide reasonable notice (for example, by posting the updated Terms with a new effective date or by notifying you through the Platform). By continuing to use the Platform after the changes take effect, you agree to the updated Terms.
